Terms and Conditions

RESERVATIONS. Reservations will be secured with a deposit of 25% due at booking, with the balance due 30 days prior to arrival. The balance will include an exit cleaning fee.

CANCELLATIONS.  Advanced deposits paid will be forfeited unless written notice of cancellation is received by Cannons by the Sea, LLC at least 90 days prior to the arrival date on Reservation Agreement.  If Guest cancels within 90 days of scheduled arrival, Guest will forfeit all monies paid unless the property is re-booked for the full term.  If the property is re-booked, Guest will receive a refund of 80% of the funds recovered.  Partial cancellations cannot be accepted and adjustments or refunds for a late arrival or early departure cannot be made.

SUBSTITUTION OF ACCOMMODATIONS.  Should circumstances beyond our control cause Guest confirmed accommodations to be unavailable prior to Guest arrival, Cannons by the Sea reserve the right to substitute comparable accommodations, if available.  Confirmed rates in these instances cannot be guaranteed.  Substitute accommodations and rates will be subject to Guest approval.  Upon notification by Cannons by the Sea that such a move is necessary, Guest will have the option to accept a substitute accommodation, if available, or cancel Guest Reservation Agreement with no cancellation penalties and full deposit will be returned to Guest.

UTILITY OVERAGE FOR WINDSURF PROPERTY.  The Windsurf property includes a private pool and jacuzzi. The rental rates include the utilities up to $150/month. Any gas bill overages exceeding $150/month (or pro-rated amount for shorter term rentals) for heating the pool and jacuzzi will be charged to the guest.

USE OF PROPERTY.  Cannons by the Sea and/or the property owner have the right to enter rental property to make repairs and to examine and protect property during an emergency.  It is agreed that an owner’s agent has the right to show the property to prospective customers upon twelve to twenty-four (12-24) hours notice.  Guest agrees to abide by and to have Guest invitees abide by the Rules and Regulations of the Condominium Association or abide by the neighborhood deed restrictions, whichever is applicable.

MAXIMUM OCCUPANCY.  The rental property cannot be occupied by more that the maximum number of persons designated by each property. Occupancy maximum is 6 for Windsurf, 4 for Dolphin Run, Sea Breeze, and High Tide, 6 for Sundance I and Pelican II, 7 for Starfish III and 8 for Sand Dollar IV. For purposes of this Reservation Agreement, occupancy is defined as any overnight visits in the rental property. In the event the maximum occupancy limit is exceeded, the Reservation Agreement will be cancelled immediately and occupants will be required to leave the property and all rental payments and deposits, whether earned or unearned, will be forfeited.

PETS. No animals of any kind shall be permitted in any rental property with the exception of Sand Dollar IV.  The Guest must acknowledge the pet upon securing the reservation and pay the required non-refundable pet fee. In the event a pet is brought onto the rental premises of properties forbidding them or without proper acknowledgement and payment of the pet fee for Sand Dollar IV, the Reservation Agreement will be cancelled immediately and occupants will be required to leave the property and all rental payments and deposits, whether earned or unearned, will be forfeited.

SMOKING.  No smoking of any kind shall be permitted in any rental property.  In the event a smoking is brought onto the rental premises of properties, the Reservation Agreement will be cancelled immediately and occupants will be required to leave the property and all rental payments and deposits, whether earned or unearned, will be forfeited.

CONDITIONS & REPAIR.  Guest agrees to keep the premises in good repair and in clean condition and to pay the cost of repairing any damage to rental property caused by Guest or Guest’s invitees.  Guest will make no alterations to or upon said property, to include the moving of furniture.  Guest acknowledges that neither the property owner, nor Cannons by the Sea has made representations or warranties as to the condition of the premises or any other matter not contained in this Reservation Agreement.  Guest agrees to return premises in as good a condition as the premises were at the time of occupancy, loss or damage caused by acts of nature excepted.  Guest will have paid for a professional departure cleaning of $120.00.

INSURANCE & INDEMNIFICATION.  Guest shall indemnify and hold harmless the property owner or Cannons by the Sea, LLC from and against any and all liabilities, claims, expenses, fees, loss of use and actions of every kind and nature arising out of the Guest’s use and occupancy of the rental property except when such has resulted due to gross negligence of the property owner or Cannons by the Sea, LLC.

DEFAULT.  In the event Guest breaches any term or provision of said Reservation Agreement, Owner shall have remedies provided by law, including the right to reenter and to sue in law or equity.

INTEREST BEARING ACCOUNT.  All deposits and any prepaid monies may be placed in an interest bearing account with any interest earned accruing to Cannons by the Sea.

CONDOMINIUM/HOMEOWNERS ASSOCIATIONS. Guests occupying a unit governed by an association shall abide by all association rules and regulations. Guest shall not be permitted occupancy until association application and approval is obtained.

RADON GAS.  Radon Gas is a naturally occurring gas, that when it has accumulated in a building in sufficient quantities, it may present a health risk to persons who are exposed to it over time.  Levels of radon gas that exceed federal and state guidelines have been found in buildings in Florida.  Additional information regarding radon and radon testing maybe obtained from Guest county health unit.
